The opening phase of the much anticipated Employment Tribunal fees refund scheme has been launched by the Government today.
In July the Supreme Court held that the fees regime was unlawful and prevented access to justice. The Employment Tribunal Refund Scheme will facilitate the repayment of fees, together with an interest payment of 0.5% (calculated from the date of payment of the fee up until the refund date). This opening phase of the scheme will last around 4 weeks and up to 1,000 claimants will be contacted with regard to refunding their claims. The full scheme will be opened up in the coming weeks.
Applicants who are not part of this initial phase can pre-register an interest in applying for a refund by emailing firstname.lastname@example.org or contacting the Employment Tribunal central office by post (addresses can be found here).
Further details as to how Respondents may (if at all) be able to claim back fees paid as part of a remedy hearing following a Tribunal claim have yet to be released.
