Following the Court of Appeal decision in de Souza v Vinci Construction (UK) Ltd the Presidents of the Employment Tribunals have published the revised bands of compensation for injury to feelings in discrimination cases. The new bands are as follows:
- Lower band – £800 to £8400 for less serious cases
- Middle band – £8400 to £25,200 for cases that do not merit an award in the upper band
- Upper band – £25,200 to £42,000 for the most serious cases
- Exceptional cases – £42,000
The new bands apply to claims issued on or after 11 September 2017 and will be reviewed in March 2018 and annually thereafter. In respect of claims presented before that date it is always open to the parties and the Tribunal to adjust the bands to reflect inflation and the Presidential Guidance provides the methodology for doing so.
